Acceptable Use Policy
Effective Date: June 8, 2026
1. SCOPE
This Acceptable Use Policy (this "AUP") governs all access to and use of Watt Data's websites, accounts, portals, services, software, platforms, APIs, MCP endpoints, SDKs, plugins, integrations, customer-hosted modules, search tools, signal retrieval tools, data access tools, audience tools, and related products and services (collectively, the "Watt Services"), and all Outputs by Users under Customer accounts, Customer Products, downstream offerings, or Trial Access. Outputs include human- or agent-readable results generated, returned, or made available through the Watt Services.
This AUP applies to direct and indirect use, paid and unpaid use, production and non-production use, human-initiated and machine-initiated use, and use through web interfaces, APIs, MCP endpoints, SDKs, plugins, integrations, automations, agents, applications, workflows, customer-hosted modules, trial access, demo access, sandbox access, or any other access method.
This AUP applies to Customer access to and use of the Watt Services and Outputs and is incorporated into and forms part of the Agreement for that purpose. If a Vendor also accesses or uses the Watt Services or Outputs as a Customer or User, this AUP applies to that access and use. Vendor provision of Vendor Data is governed by the Acceptable Data Policy. Capitalized terms not defined in this AUP have the meanings given in the Agreement. Customer is responsible for all access to and use of the Watt Services and Outputs through Customer's account, credentials, systems, integrations, applications, agents, products, services, workflows, Customer Products, or downstream offerings, including access or use by Customer Users, Customer Agents, Downstream Customers, Downstream Users, and Downstream Agents. References in this AUP to Downstream Customers, Downstream Users, Downstream Agents, Customer Products, downstream offerings, or other downstream access are for responsibility, restriction, and enforcement purposes only, do not create a separate relationship between Watt and any Downstream Customer, Downstream User, or Downstream Agent, and remain subject to the Agreement, the applicable Order Form, and this AUP.
If you access or use Watt Services or Outputs, this AUP applies to you. "User" includes both people and systems that access or use Watt through a Customer account, product, workflow, integration, agent, or downstream offering. Customer is responsible for making sure its Users follow this AUP.
No legal agreement, legal terms, commercial terms, order form, addendum, amendment, purchase order, statement of work, email, side letter, platform configuration, technical setting, support communication, course of dealing, or other document, communication, or arrangement that Watt enters into with any Customer, User, or other Participant may waive, narrow, modify, supersede, or create an exception to this AUP for any Customer access, User access, Customer Product, use case, access method, data category, technical configuration, or downstream offering. Any Order Form controls only for deal-specific commercial terms expressly stated in it and does not waive, narrow, modify, supersede, or create an exception to this AUP. Watt may update this AUP only by updating it on a generally applicable basis.
2. DEFINITIONS
2.1. "Customer Agent" means any AI agent, large language model, MCP client, workflow, application, script, automation, bot, software tool, integration, or other non-human system that accesses, queries, retrieves, processes, exports, transmits, activates, or otherwise interacts with the Watt Services or Outputs under or through Customer's account, credentials, systems, instructions, configuration, Customer Products, products, services, workflows, or authority.
2.2. "Customer Input" means any query, prompt, instruction, file, spreadsheet, CRM data, customer list, identifier, audience criteria, seed audience, configuration data, integration payload, enrichment request, or other data or content submitted to the Watt Services by or on behalf of any User.
2.3. "Customer User" means an employee, contractor, administrator, developer, representative, or other natural person who accesses or uses the Watt Services or Outputs under or through Customer's account, credentials, systems, or authority.
2.4. "Downstream Agent" means any AI agent, large language model, MCP client, workflow, application, script, automation, bot, software tool, integration, or other non-human system that accesses, queries, retrieves, processes, exports, transmits, activates, or otherwise interacts with the Watt Services or Outputs through or on behalf of a Downstream Customer.
2.5. "Downstream Customer" means any customer, client, subscriber, licensee, end user, or other third party to whom Customer makes available, directly or indirectly, any Outputs or functionality powered by the Watt Services through Customer's Customer Product, product, service, platform, workflow, agent, application, integration, campaign, or other offering.
2.6. "Downstream User" means any natural person who accesses or uses the Watt Services or Outputs through or on behalf of a Downstream Customer.
2.7. "Precise Geolocation" means any data derived from a device and used or intended to be used to locate a consumer within a geographic area equal to or less than the area of a circle with a radius of 1,850 feet.
2.8. "User" means Customer, each Customer User, each Customer Agent, each Downstream Customer, each Downstream User, each Downstream Agent, and any other person or system that accesses or uses the Watt Services or Outputs under or through Customer's account, credentials, systems, integrations, products, services, workflows, authority, or commercial relationship, whether or not such access or use was authorized by Watt.
3. PERMITTED USES
Subject to this AUP, the Agreement, the applicable Order Form, applicable law, and the usage limits, access permissions, field restrictions, and other parameters applicable to Customer's account, integration, product, service, or downstream offering, Users may access and use the Watt Services and Outputs for lawful commercial purposes, including Customer's own use, client-services use, and productized or embedded use where permitted under the Agreement and not limited by the applicable Order Form.
Permitted uses may include:
3.1. Search and Signal Retrieval. Querying the Services to retrieve commercially relevant signals, records, relationships, attributes, or search results.
3.2. ICP Modeling. Defining, refining, scoring, and analyzing ideal customer profile criteria, commercially relevant attributes, and similar relevance signals.
3.3. Audience and Cohort Creation. Building, refining, and exporting audiences, cohorts, clusters, segments, personas, lookalike audiences, and target lists using Outputs for lawful marketing, sales, advertising, analytics, and lifecycle programs.
3.4. Data Enrichment and Identity Resolution. Enriching, matching, resolving, deduplicating, or reconciling lawfully held commercial records within Customer's systems or authorized workflows.
3.5. Advertising and Audience Activation. Using Outputs for lawful advertising, audience activation, campaign planning, measurement, and go-to-market workflows, including through DSPs, clean rooms, CDPs, CRMs, marketing automation platforms, sales engagement tools, and other adtech or martech systems.
3.6. Analytics and Reporting. Performing internal analytics, reporting, measurement, and business intelligence on campaigns, programs, systems, or workflows that use the Services or Outputs.
3.7. Workflow and System Integration. Integrating the Services and Outputs into authorized internal or customer-facing products, services, workflows, applications, agents, and systems.
4. CONDITIONS ON USE
Customer must comply with the Agreement, this AUP, applicable documentation made available by Watt, all Compliance Metadata, and all applicable laws, regulations, industry rules, platform terms, self-regulatory codes, and contractual obligations applicable to Customer's access to or use of the Watt Services, Customer Input, Vendor Data, Outputs, or Watt-powered functionality.
Each User must comply with this AUP, all applicable laws, and all restrictions, notices, controls, usage parameters, Compliance Metadata, and documentation made available to that User through Customer, the Watt Services, or the applicable product, service, workflow, integration, or downstream offering.
All use must remain within the usage limits, credits, rate limits, field restrictions, access permissions, export rights, and other technical or commercial parameters applicable to Customer's account, integration, product, service, Customer Product, or downstream offering.
Users must preserve all usage restrictions, legal notices, product warnings, field restrictions, suppression indicators, opt-out indicators, provenance information, and other controls made available through the Watt Services or Outputs.
5. CUSTOMER AND USER RESPONSIBILITY
Customer is responsible for all access to and use of the Watt Services and Outputs through Customer's account, credentials, systems, integrations, applications, agents, products, services, workflows, Customer Products, or downstream offerings, including access or use by Customer Users, Customer Agents, Downstream Customers, Downstream Users, and Downstream Agents.
Each User is responsible for the User's own access to and use of the Watt Services and Outputs. Users must use the Watt Services and Outputs only for lawful purposes and in accordance with this AUP.
Users must maintain reasonable human oversight, technical controls, operational controls, and compliance controls appropriate to the nature of their use of the Watt Services and Outputs.
6. CUSTOMER INPUTS
No User may submit Customer Input if the Customer Input, or any data or content included in it:
6.1. is data or content that the User or Customer lacks the lawful right to submit or use;
6.2. was obtained, derived, scraped, compiled, transferred, or submitted in violation of applicable law, contract, privacy notice, platform terms, data source terms, or third-party rights;
6.3. is submitted for any purpose prohibited by this AUP;
6.4. contains passwords, authentication credentials, raw payment card data, malicious code, malware, or content designed to disrupt, damage, or gain unauthorized access to any system;
6.5. is intended to elicit Outputs for FCRA-covered, eligibility, discriminatory, unlawful surveillance, harassment, sensitive-location targeting, or other prohibited purposes; or
6.6. is otherwise unlawful, infringing, deceptive, defamatory, harassing, or abusive.
Users must exercise heightened care when submitting Customer Input containing regulated, sensitive, or restricted data, including health, financial, biometric, genetic, Precise Geolocation, minor-related, protected-class, or other sensitive personal information. Users are responsible for ensuring that any such Customer Input is submitted and used in compliance with applicable law and all restrictions imposed by the applicable data source, platform, vendor, rights holder, or privacy notice.
7. GENERAL PROHIBITED USES
No User may access or use the Watt Services, Customer Input, or Outputs to:
7.1. violate any applicable law, regulation, rule, order, contractual obligation, platform rule, industry self-regulatory standard, sanctions, restricted-party, export control, foreign adversary, bulk sensitive data, government-related data, or data-transfer restriction;
7.2. engage in fraud, identity theft, account takeover, phishing, impersonation, pretexting, social engineering, deceptive business practices, or misleading attribution;
7.3. harass, stalk, threaten, intimidate, dox, defame, extort, surveil, or otherwise harm any individual or group;
7.4. send, enable, or support unlawful, deceptive, unsolicited, or non-compliant advertising, marketing, sales, or outreach communications;
7.5. infringe, misappropriate, or violate intellectual property, privacy, publicity, contractual, or other third-party rights;
7.6. re-identify deidentified or pseudonymized data except as expressly permitted by applicable law, the applicable data source terms, and this AUP;
7.7. circumvent, disable, or interfere with security, integrity, access-control, usage-measurement, entitlement, field restriction, suppression, opt-out, watermarking, or policy-enforcement features;
7.8. interfere with, disrupt, degrade, overload, probe, scan, or impair the Services or related infrastructure;
7.9. share, sell, transfer, sublicense, pool, rotate, or otherwise make credentials available to any unauthorized person or system;
7.10. use automated means to access the Watt Services except through documented and permitted interfaces;
7.11. use the Watt Services or Outputs for weapons, unlawful surveillance, unlawful intelligence activity, or any activity reasonably likely to result in death, serious bodily injury, or significant damage to critical infrastructure; or
7.12. structure activity to evade, avoid, or frustrate this AUP.
8. FCRA, ELIGIBILITY, AND REGULATED DECISIONS
The Watt Services and Outputs are not designed, intended, authorized, or validated for use as a consumer report, investigative consumer report, background check, screening tool, eligibility tool, or FCRA-compliant service.
No User may access, use, request, retrieve, export, transmit, integrate, or rely on the Watt Services or Outputs, in whole or in part, as a factor in establishing any consumer's eligibility for, or to make, inform, recommend, evaluate, support, or deny any decision about:
8.1. credit or the extension of credit;
8.2. employment, hiring, retention, promotion, reassignment, compensation, background screening, contractor engagement, or termination;
8.3. insurance underwriting, eligibility, pricing, or claims;
8.4. housing, tenancy, tenant screening, rental, mortgage, or real estate eligibility;
8.5. healthcare eligibility, treatment, coverage, or benefits;
8.6. education, admissions, financial aid, scholarships, or academic standing;
8.7. government benefits, licensing, public assistance, or entitlements;
8.8. immigration or citizenship status; or
8.9. any other eligibility determination, adverse action, consumer report, or permissible-purpose use regulated by the Fair Credit Reporting Act or any analogous law.
No User may represent, market, package, label, or otherwise hold out the Watt Services or Outputs as a consumer report, screening tool, eligibility tool, background check, or regulated-decision service.
9. ANTI-DISCRIMINATION
No User may use the Watt Services, Outputs, or Customer Input to unlawfully discriminate against, or to facilitate, enable, automate, or conceal unlawful discrimination against, any individual or group based on race, color, ethnicity, national origin, ancestry, citizenship or immigration status, religion or creed, sex, gender, gender identity or expression, sexual orientation, marital or familial status, pregnancy, age, disability, genetic information, military or veteran status, source of income, or any other characteristic protected by applicable law.
No User may use protected characteristics, or proxies for protected characteristics, to construct, define, score, rank, segment, include, exclude, target, suppress, or model audiences, cohorts, clusters, personas, ICPs, or lookalike audiences in a manner that violates applicable law.
Facially neutral attributes, signals, geography, behavioral data, affinities, interests, language preferences, or similar variables may not be used in a manner that is intended to produce, or that unlawfully produces, discriminatory outcomes.
10. SENSITIVE AND REGULATED DATA USE
Certain data categories and use cases are subject to heightened legal, contractual, platform, and regulatory restrictions. Users are responsible for determining whether they may lawfully query, access, export, activate, disclose, or use any regulated, sensitive, or restricted data, Vendor Data, or Outputs.
Users must exercise particular caution when using data or Outputs relating to health, financial status, biometric information, genetic information, Precise Geolocation, minors, protected characteristics, sensitive locations, citizenship or immigration status, political activity, religious affiliation, union membership, criminal history, or other sensitive or regulated categories.
No User may use the Watt Services or Outputs to:
10.1. violate restrictions imposed by a data source, data vendor, platform, privacy notice, contract, Compliance Metadata, or applicable law;
10.2. infer, derive, append, enrich, or assign sensitive characteristics to individuals where prohibited by law or applicable source restrictions;
10.3. target, exclude, suppress, profile, or disadvantage individuals based on sensitive or regulated characteristics in violation of applicable law;
10.4. track, surveil, monitor, or reconstruct the real-time or historical physical movements of a natural person;
10.5. build audiences, segments, cohorts, or lookalike models based on a person's visit to, presence at, proximity to, residence near, or association with a sensitive location, except where lawful and expressly permitted by all applicable source restrictions; or
10.6. use sensitive or regulated data for harassment, intimidation, unlawful surveillance, discriminatory targeting, or any prohibited use under this AUP.
Outputs may include or be derived from health-related data or health-related inferences, including information or inferences relating to medical conditions, treatments, prescriptions, medications, medication interests, health purchases, health browsing behavior, condition-specific search behavior, wellness, fitness, diet, addiction, mental health, reproductive health, health-related location signals, or condition-specific audiences. Users are responsible for determining whether their intended query, receipt, activation, disclosure, targeting, segmentation, modeling, or other use of such Outputs complies with all applicable laws, platform rules, data source restrictions, Compliance Metadata, consent requirements, authorization requirements, and consumer rights signals. Outputs containing health-related data or health-related inferences do not constitute the consent, authorization, or legal basis that applicable law may require for use of that data. No User may use health-related Outputs for healthcare eligibility, insurance eligibility, insurance pricing, medical advice, discriminatory targeting, harassment, or any other prohibited use under this AUP.
Outputs may include or be derived from minor-related data, including information or inferences relating to minors, children, students, child age bands, household child composition, child-directed interests, or minor-related audience attributes. Users are responsible for determining whether their intended query, receipt, activation, disclosure, targeting, segmentation, modeling, or other use of such Outputs complies with all applicable laws, including children's privacy laws, student privacy laws, age-appropriate design requirements, and similar restrictions. Outputs containing minor-related data do not constitute the consent, authorization, or legal basis that applicable law may require for use of that data. No User may use minor-related Outputs to target, profile, advertise to, or make decisions about minors in a manner prohibited by applicable law or this AUP.
Watt may restrict, filter, suppress, exclude, or decline to surface certain categories of Customer Input, queries, Outputs, Vendor Data, data sources, or use cases where Watt reasonably determines that such activity presents legal, regulatory, privacy, security, operational, consumer harm, or reputational risk.
11. ADVERTISING, AUDIENCE ACTIVATION, AND COMMUNICATIONS
Users may use Outputs for lawful advertising, audience activation, campaign planning, measurement, enrichment, targeting, retargeting, and go-to-market workflows, including through DSPs, clean rooms, CDPs, CRMs, marketing automation platforms, sales engagement tools, and other adtech or martech systems, subject to this AUP, the Agreement, applicable platform and channel terms, Compliance Metadata, and applicable law.
Outputs do not themselves constitute consent, opt-in, permission to contact, an established business relationship, or any other legal basis for advertising, marketing, sales outreach, or other communications.
Before using Outputs for advertising, marketing, sales outreach, audience activation, targeting, retargeting, or communications, Users must apply all applicable suppression, unsubscribe, do-not-contact, do-not-email, do-not-call, deletion, opt-out, do-not-sell/share, Global Privacy Control, platform-level, Compliance Metadata, and similar restriction signals known to or provided to them. Users are responsible for complying with all applicable communications laws, rules, and platform requirements, including CAN-SPAM, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the National Do Not Call Registry, state telemarketing and mini-TCPA laws, sender-identification rules, unsubscribe and STOP-message requirements, consent requirements, and sender-reputation rules.
No User may use the Watt Services or Outputs to send, facilitate, or support:
11.1. unlawful, deceptive, fraudulent, harassing, threatening, defamatory, obscene, or otherwise prohibited communications;
11.2. communications using spoofed, falsified, or misappropriated sender identifiers, domains, originating numbers, headers, or routing information;
11.3. advertising, marketing, targeting, retargeting, or outreach campaigns that violate applicable consent, notice, opt-out, unsubscribe, do-not-call, platform, Compliance Metadata, or sender-reputation rules; or
11.4. campaigns that promote unlawful goods or services or that exploit, induce, or facilitate any prohibited use under this AUP.
12. SUPPRESSION, OPT-OUT, AND RESTRICTION SIGNALS
Users may not use the Watt Services or Outputs to circumvent, avoid, reverse, re-identify, re-acquire, re-enrich, re-append, re-target, or otherwise work around any deletion, suppression, opt-out, do-not-contact, do-not-sell/share, do-not-serve, unsubscribe, Compliance Metadata, or similar restriction signal known to or provided to the User.
Users must not use suppression lists, deletion lists, opt-out lists, do-not-contact lists, or similar restriction data to target, profile, enrich, re-identify, or re-engage listed individuals.
13. APIS, MCP, AUTOMATIONS, AND AGENTS
Programmatic and automated access to the Watt Services and Outputs, including access through APIs, MCP endpoints, SDKs, plugins, integrations, scripts, workflows, bots, Customer Agents, customer-hosted modules, and Downstream Agents, must comply with this AUP and all applicable technical restrictions.
Users must not:
13.1. spoof, omit, or misrepresent account identifiers, user-agent strings, headers, request metadata, plugin identifiers, agent identifiers, or the origin or nature of any request;
13.2. use APIs, MCP endpoints, SDKs, plugins, integrations, automations, or agents to exceed or evade usage limits, rate limits, field restrictions, access permissions, export limits, credit limits, or other Watt Services controls;
13.3. configure or permit agents to exceed authorized scope, bypass Watt Services controls, or operate in violation of this AUP;
13.4. configure or permit agents to take material consumer-facing, legally significant, irreversible, or external actions without appropriate human oversight;
13.5. use prompt injection, indirect prompt injection, jailbreaking, tool-use exploitation, credential extraction, or other adversarial techniques to manipulate the Watt Services or any agent interacting with the Watt Services;
13.6. allow any integration, MCP client, plugin, agent, or third-party tool to expose Outputs to unauthorized persons, systems, models, or environments; or
13.7. use agents to self-replicate, self-deploy, spawn additional accounts or agents, acquire or escalate credentials, persist unauthorized access, or chain Outputs across accounts or tenants to evade controls.
14. NO COMPETITIVE USE OR UNAUTHORIZED MODEL TRAINING
No User may access or use the Watt Services or Outputs to design, develop, market, offer, operate, or support any product, service, dataset, model, API, MCP server, agent, integration, search index, identity graph, audience product, enrichment product, or other offering that competes with, replicates, or is substantially similar to the Watt Services or any feature or component of the Watt Services.
No User may use the Watt Services or Outputs to train, pre-train, fine-tune, distill, retrieve-augment, ground, calibrate, validate, evaluate, red-team, or otherwise develop or improve any artificial intelligence model, machine-learning model, large language model, foundation model, embedding model, classifier, ranker, generative system, or other algorithmic system, except to the extent expressly permitted in a written agreement with Watt.
No User may use the Watt Services or Outputs to create, compile, assemble, or derive any standalone database, data product, lookup table, embedding store, vector index, knowledge graph, training corpus, evaluation set, or other dataset except as expressly permitted by Watt.
No User may reverse engineer, recreate, infer, or otherwise discover Watt's data sources, Signal Graph, indexing methods, signal processing methods, identity resolution logic, matching algorithms, scoring methodologies, prompts, models, weights, training data, or proprietary methods.
